Payment Terms:
1.If making a reservation for the first time, a down payment of 30% of the estimated rental fee will be charged to a valid credit card, bank transfer or cash.
2. Before leaving port with the boat, payment is made in cash or by credit card or cash.
3. Included in the charter prices is a comprehensive insurance coverage with a €  1.200.00 co-payment. This co-payment is put on hold with a valid credit card or cash before beginning your trip.

General Terms and Conditions for Classic Yacht Charter
The following terms and conditions form an integral part of the lease contract concluded between charterer and lessor of a boat. The charterer recognises the application of the provisions contained in these terms and conditions both to itself and to its co-travellers on reservation.

1. Reservation, Conclusion of Contract and Payment
Reservation shall be made by placement of written order by the charterer and the contract shall be concluded on written confirmation by the lessor. 30% of the lease fee is payable immediately on booking. The remaining sum shall be paid on hand-over of the yacht. Statutory value added tax is included in the lease fee. A deposit of € 1.200.00 shall be made before the date of departure.
2. Cancellation of Booking
The charterer shall at all times and for any reason be entitled to cancel the booking. Cancellation must be made in writing. On cancellation, the following sums shall be due:
30% of the lease fee for cancellations made more than 2 weeks before the planned date of departure.
50% of the lease fee for cancellations made less than 2 weeks before the planned date of departure.
We therefore recommend the taking out of appropriate travel cancellation insurance.
3. Non-availability
If, on account of unforeseeable events, the lessor is not be able to make the boat available, it shall be entitled to offer a similar boat of the same berth size. Should this not be possible within a period of 24 hours, the lease fee shall be reimbursed in full. Liability beyond the lease fee is expressly excluded.
The lessor similarly accepts no liability for events affecting the journey, such as the closure of water gates, high or low tides, filling station closure, the accuracy of navigation maps and gauges etc.
4. Lease Fee
The lease fee includes: Use of the boat and equipment (supplementary sheet), instruction and test trip on charter basis as well as liability and hull insurance. The boat shall be handed over with a full fuel tank and shall be returned in the same condition. In the case that the boat is not returned on a full fuel tank, invoice shall be made on the basis of hours of operation (€ 8.00 per hour). All operational and auxiliary materials (diesel, gas, oil etc) as well as disposal of faecal waste etc. shall fall shall be settled on the charterer’s account. Beds are, for reasons of hygiene, to be used exclusively with bed linen. The charterer shall bring its own towels; alternatively, these can be supplied on the payment of a fee.
5. Liability of the Charterer
The charterer shall treat the boat with greatest care – as if it were its own property. Pleasure craft liability and hull insurance with risk retention of € 1.200.00 have been concluded for the yacht.These € 1.200.00 are to be paid in full before the departure date and shall be refunded to the charterer in full on punctual return of the yacht free of damage. The charterer is liable in full for all intentional damage as well as damage resulting for its gross negligence.
The personal property of the charterer and accidental damage suffered by any persons present on the yacht are not insured, and all liability for such is excluded. The charterer is liable for the proper technical care and maintenance of the yacht during the charter period such as, for instance, oil-level; coolant level, filter and discharge; bilgewater; correct fuelling etc.. The charterer shall indemnify the lessor against all civil and criminal claims made by third parties as well as for all associated legal costs incurred by the lessor on account of the action or inaction of the charterer. The charterer accepts the yacht at its own risk.
The conclusion of a contract of insurance by the lessor shall not constitute a release from liability for any damage not covered by the insurance policy, or in respect of which the insurance expressly reserves a right of indemnity against the charterer. This applies in particular for damage resulting from gross negligence, intention, non-adherence to the provisions of contract as well as for all such consequential damage.
Should the yacht, at the fault of the charterer, be damaged to an extent such as to prevent its further use, the charterer shall be liable for all losses arising therefrom. The taking out of skipper liability insurance is recommended.
6. Acceptance and Return
The acceptance as well as the return of the vacated boat shall take place at the agreed times and at the agreed locations. Both on the acceptance and the return of the boat, the boat shall be assessed with regard to completeness and freedom from damage.
The lessor shall be entitled to deduct all costs for damage or loss from the deposit. In respect of damage not capable of immediate assessment, the lessor shall be entitled to retain the full amount of the deposit until such time as the extent of damage can finally and definitely be determined. Should the charterer omit to make notice of any loss or damage, the lessor shall be entitled to have recourse against it at a subsequent date. The charterer is liable for all damage ensuing from the late return of the yacht.
7. Navigation Licence, Routes and Instruction
The steerman must at least be in possession of an official pleasure craft skipper’s licence (excepted: boats not subject to licence). The steerman need not necessarily be the charterer.
The agreed route comprises the inland waters between the Elbe and Oder rivers. Instruction will be given by the lessor. Should it become apparent during the course of instruction that the charterer is not suitable for the navigation of a boat, the lessor shall be entitled to deny the handing over of the boat.
8. Average
Should any average, damage or loss result en route, the lessor shall be informed without delay. Each ground collision shall be reported. The telephone number for this purpose can be found in documents supplied. We are at pains to provide immediate help. Small repairs up to approx. € 100.00 may be instigated by the charterer without further ado. All costs incurred as a result shall be reimbursed in full on presentation of proof of payment. Should demurrage be necessary on account of average or technical damage, the lessor shall not be liable.
9. Miscellaneous
The boat shall be returned at the end of the lease period in a proper condition. Appropriate footwear shall be worn on board (boat shoes or trainers with non-slip, non-marking soles).
The taking of pets on board requires express permission.
All Boats are Non Smoker Boats
The final cleaning fee shall be charged at the level fixed in the price list ( actually € 85,00 ).
Need the boat extra cleaning, we will save € 125,00 from caution.
10. Jurisdiction and Validity
Place of fulfilment is the respective place of business. Jurisdiction on dispute rests with the competent court at the respective place of business. The contract is governed exclusively by the provisions of German law. All assurances and subsidiary agreements are required to be made in writing. Should one or more individual provisions be or become void, the validity of the contract as a whole shall not be affected.
